1. Acceptance of Terms
By accessing or using the Cardiotune website, platform, API, or services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Services on behalf of an organization, you are agreeing to these Terms for that organization and promising that you have the authority to bind that organization to these terms.
2. Use of Services
Cardiotune provides a B2B intelligence platform for Bicycle Sharing Systems (BSS). You agree to use the Services only for purposes that are permitted by these Terms and any applicable law, regulation, or generally accepted practices in the relevant jurisdictions.
- You will not interfere with or disrupt the Services or servers or networks connected to the Services.
- You will not reverse engineer, decompile, or otherwise attempt to extract the source code of the software.
- You are responsible for maintaining the confidentiality of your account credentials.
3. Data & Intellectual Property
Your Data: You retain ownership of all data, information, and content you upload or stream to the Cardiotune platform ("Customer Data"). You grant Cardiotune a license to host, copy, transmit, and display your data as necessary for us to provide the Services.
Our IP: Cardiotune retains all right, title, and interest in and to the Services, including all related intellectual property rights. The "Cardiotune" name and logo are trademarks of Cardiotune.
4. Service Levels & Availability
While we aim for 99.9% uptime, we do not guarantee that the Services will be uninterrupted, timely, secure, or error-free. We may temporarily suspend the Services for maintenance or upgrades. For Enterprise customers, specific SLAs are defined in your Master Services Agreement (MSA).
5. Limitation of Liability
To the maximum extent permitted by law, Cardiotune shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Services.
6. Changes to Terms
We reserve the right to modify these Terms at any time. If we make material changes, we will provide you with reasonable notice prior to the changes taking effect, either by emailing the email address associated with your account or by posting a notice on our website.
